1. Who we are?

This privacy policy discloses the privacy practices of Quality Consultants New Zealand Limited in relation to the QCONZ Freshwater Farm Plan system (the System) and Website.

The System processes data submitted by the customer and their users to build a Freshwater Farm Plan.

This policy sets out how we handle personal information collected by the System and Website.

We are bound by the Privacy Act 2020 (“Privacy Act”) and all supporting regulations.

2. What personal information do we collect about you?

When you use the QCONZ Freshwater Farm Plan Website or the System, QCONZ may collect your personal information. The types of personal information QCONZ collects from you depend on the features you use.

QCONZ Freshwater Farm Plan System customer information:

• Purchase Information: QCONZ may collect your name, billing address, email address, telephone number, credit card number and expiration date when you make a purchase. This information is used to provide the products and services that you have ordered or requested, to process and send order confirmations (or other transactional information) and/or to provide customer service.

• Account Information: QCONZ may collect your name, email address, mailing address, and postcode if you create an account with us. This information will be used to help you keep track of your orders, to keep you updated about exclusive offers, and updates related to the Sites, and to facilitate checkout during purchases.

• System Information: The System collects personal data that is entered into the System by you and any other user with access to your farm.

• Information Relating to Inquiries: QCONZ may collect your name, email address and phone number if you contact us with a question. This information may be used so that we can respond to your question.

• Information for Commercial Communications: QCONZ may collect your name, email address, and mailing address if you sign up to receive promotional emails from us. This information may be used to contact you about sales, exclusive offers and new features available through the Sites.

3. What are the purposes for which the QCONZ Freshwater Farm Plan System collects, holds, uses, and discloses your information?

The System collects personal information to fulfil its intended purpose of producing a freshwater farm plan. This information is required for the System to function.

To fulfil this purpose, QCONZ may need to access the data to provide the service, to correct and address technical or service problems, or to follow instructions of the System customer whose users have submitted the data, or in response to contractual requirements.

QCONZ also collect personal information from our customers via the website to respond to customer queries and/or to complete the purchase process.

4. How does QCONZ collect your information?

The System collects customer information via forms where the user can input and upload data.

QCONZ collects customer information via customer enquiry forms submitted via the website and the online customer purchase process.

5. What information does QCONZ collect automatically?

Whenever an individual visits or interacts with a QCONZ Freshwater Farm Plan website or System (Platforms) QCONZ, as well as any third-party service provider and/or advertiser, may use a variety of technologies that automatically or passively record information about how the platforms are accessed and used (“Usage Information”). Usage Information may include IP address or other unique identifier for the device used to access a Platform (“Device Identifier”), browser type, “Device” type (computer, mobile phone, tablet, or other device), operation system, application version, date and time of visit, pages viewed, preceding page views and use of features or applications on the Platforms such as interactions with connections or groups.

Usage Information helps keep QCONZ-owned Platforms relevant to users and allows content to be tailored to users’ interests. Usage Information is anonymised.

QCONZ may use Device Identifiers to help us administer Platforms, diagnose problems with its servers, analyse trends, observe Platform usage and activity over time, help identify individuals and their shopping carts, and gather broad demographic information for aggregate use.

Cookies (data files placed on a Device when it is used to visit a Platform) may be used to associate individuals with social media platforms such as Facebook and, if chosen, enable interaction between activities on QCONZ’s Platforms and those social media platforms. QCONZ or its vendors may place cookies on an individual’s Device for security purposes, or to allow the selection of ads or offers that are most likely to appeal, based on interests, preferences, location, or demographic information).

6. Sharing of personal information

QCONZ Freshwater Farm Plan system user:

QCONZ do not share personal information about users.

QCONZ do not sell, trade, or otherwise transfer your personally identifiable information to outside parties, without your consent, other than for the express purpose of delivering the purchased service requested or billing for that service.

QCONZ do not have any relationship with Users with whom the subscriber adds to their Freshwater Farm Plan account. Subscribers(s) are responsible for ensuring that Users are provided with appropriate notice and choice with respect to their personal data being collected and shared.

QCONZ Freshwater Farm Plan System customer:

QCONZ will only use or disclose customer information as follows:

a) To third parties where QCONZ have retained those third parties to assist us to:
– prevent and resolve unauthorised access to, or attacks on QCONZ Systems; or
– to provide the product or service you have requested, so long as those parties agree to keep the information confidential.

b) for direct marketing of products or services; or

c) Users with appropriate permissions for the property may choose to share information with government agencies, law enforcement authorities, regulators, or dispute resolution bodies as required by applicable regulations or legal obligations. QCONZ upholds strict privacy requirements and will only disclose information if legally compelled by a court order or subpoena. In such cases, QCONZ will notify the owner before any disclosure, unless prohibited by law.

By providing QCONZ with your email address you consent to receiving emails from QCONZ advising of updates, and products and services available. You may unsubscribe from QCONZ’s email database at any time.

7. How do we secure/ protect your personal information?

All information is securely stored on the QCONZ server. QCONZ will take reasonable steps to protect your information from misuse, loss, interference, and unauthorised access, modification, or disclosure.

Some of the ways in which your information is protected:

• QCONZ implements a variety of security measures to maintain the safety of customer personal information when you place an order or enter, submit, or access your personal information.

• The use of secure servers. All supplied credit information is transmitted via Secure Socket Layer (SSL) technology, accessible only by those authorized with restricted access rights to such systems and are required to keep the information confidential.

• The storage of information entered on the website in encrypted files such as Secure Socket Layer (SSL) protocol.

• Utilising and maintaining information security applications to prevent unauthorised access or damage to electronically stored information, such as requiring identifiers and passwords, firewalls, and anti-virus software.

• By backing up data periodically to avoid loss during any hardware or software failure events. QCONZ data backups are deleted after 30 days.

8. How long does QCONZ retain your personal information?

Personal information is only retained if QCONZ needs it for the purposes for which it was originally collected (or to which you have subsequently consented), for other legitimate purposes (such as regulatory compliance) and as permitted or required by applicable laws.

An individual may request the deletion of any account information by contacting us using the contact details set out at the bottom of this policy. QCONZ will delete the personal information it holds (unless needed to retain it for the purposes set out in this Privacy Statement).

9. How long can you access and correct your personal information held by QCONZ?

Any individual has the right to access and ask to correct any inaccurate personal information held and may be reviewed or corrected on request. Please contact QCONZ using the details set out at the bottom of this Privacy Statement.

Accessing information may be refused in a few circumstances, such as where the information relates to anticipated legal proceedings. If access is denied or restricted, QCONZ will contact individuals to let them know why, unless having regard to the grounds for the refusal, it would be unreasonable for us to do so. Any individual may make a complaint about a refusal to the Office of the Privacy Commissioner.

10. Complaints Resolution

If you believe that your privacy has been compromised, or feel that QCONZ have breached the privacy laws, you are entitled to make a complaint. Complaints can be made by contacting the relevant person or department or by contacting QCONZ using the contact details set out at the bottom of this Privacy Statement

QCONZ endeavors to respond within 24 hours to acknowledge the complaint and explain how it will be investigated. QCONZ will try to resolve complaints within 20 working days and in writing explain the reasons for our decision. If this is not possible, QCONZ will be in contact with a revised timeframe.
